Terms of Service

1. Introduction

Welcome to Coclo ("we," "us," or "our"), a campus-based marketplace designed specifically for college students to buy and sell secondhand clothing. These Terms of Service ("Terms") govern your access to and use of the Coclo mobile application and all related services (collectively, the "Service"). By downloading, accessing, or using Coclo, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

We may update these Terms from time to time to reflect changes in our practices, legal requirements, or the evolution of our Service. We will notify you of any material changes through the app or via email. Your continued use of Coclo after such changes constitutes acceptance of the updated Terms.

2. Eligibility and Account Creation

To use Coclo, you must be a currently enrolled student at an accredited college or university where our Service is available and be at least 13 years old. Currently, the Service is available to students at the University of Chicago, with plans to expand to other campuses.

Creating an account requires a valid university email address and completion of our verification process. You are responsible for providing accurate and complete information during registration and keeping this information updated. We reserve the right to verify your student status at any time.

You must maintain the confidentiality of your account credentials and are responsible for all activities that occur under your account. If you suspect any unauthorized use of your account, you must notify us immediately. Each user may maintain only one active account, and sharing accounts is prohibited.

3. Platform Rules and Conduct

Our Service facilitates buying, selling, and exchanging secondhand clothing within campus communities through features like AI-assisted listing creation, secure messaging, try-on scheduling, and facilitated meetups. All users must conduct themselves responsibly and respectfully while using these features.

Users are expected to provide accurate listing information, respond to messages promptly, honor scheduled commitments, and follow our Community Guidelines in all interactions. All transactions must be completed exclusively through our platform's payment system.

4. Listings and Transactions

You may only list items that you physically possess and have the right to sell. While our AI system may assist in generating listing descriptions, you are responsible for ensuring the accuracy of all content before posting. Listings must include accurate descriptions and images that truthfully represent the item's condition.

All sales must be completed through our designated payment processor, Stripe, and you agree to comply with Stripe's Connected Account Agreement and Services Agreement. Off-platform transactions are prohibited and may result in account suspension.

Certain items are prohibited from our platform, including counterfeit goods, stolen merchandise, undergarments, swimwear, and items that violate intellectual property rights. Please refer to our [Selling Guidelines] for a complete list of prohibited items.

5. Payments, Fees, and Meetups

We maintain a straightforward fee structure to support our platform's operations. Sellers are charged a 10% service fee on successful sales, and buyers who request try-on appointments pay a $2.50 try-on fee. These fees may be refundable under certain conditions as detailed in our Refund Policy. We reserve the right to modify our fee structure with notice to our users.

For purchases made through the iOS app, payment will be charged to your Apple ID account at the confirmation of purchase.

All meetups must occur in designated locations on or near campus during reasonable hours. Users are expected to follow safety protocols and best practices outlined in our Community Guidelines for both try-on appointments and purchase exchanges. Any issues with item condition should be documented and reported according to our Refund Policy.

6. Content Rights and Privacy

Content you post on Coclo, including photos, descriptions, messages, and feedback, remains your property. However, by posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, modify, and distribute your content for operating and promoting our Service. This license continues even after you stop using our Service.

You must have all necessary rights to the content you post, and it must not infringe on any third party's rights. We may remove any content that violates these Terms or our Community Guidelines.

We collect and use information as described in our Privacy Policy, which is incorporated into these Terms by reference. This includes email verification, transaction processing, communication monitoring, and content storage. By using our Service, you consent to these data practices.

7. Account Management and Termination

You may delete your account at any time through the app. We may suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a risk to our community. Upon termination, active listings will be removed, pending transactions will be cancelled, and account access will be revoked.

We retain certain account information for legal compliance and dispute resolution purposes. Content shared by other users may remain visible on the platform even after account termination.

8. Liability and Dispute Resolution

The Service is provided "as is" without warranties of any kind. While we strive to maintain a safe and reliable platform, we are not liable for disputes between users, item quality issues, user behavior during meetups, technical interruptions, loss of content, or indirect or consequential damages. Our maximum liability is limited to the amount of fees paid for the transaction in question.

We encourage users to resolve disputes amicably through our in-app messaging system. For issues that cannot be resolved directly between users, please follow the procedures outlined in our Refund Policy and Community Guidelines.

9. Indemnification

You agree to indemnify and hold harmless Coclo, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, your content, your violation of these Terms, or your violation of any third-party rights.

10. Governing Law and Contact

These Terms are governed by United States federal law. Any disputes shall be resolved in accordance with federal law in appropriate federal courts. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.
